The Planning and Development Department has received an application from Camponi Housing Corporation (the applicant) proposing to amend the Zoning Agreement for 727 and 803 Hart Road.

Originally approved by City Council in 2020, the current Zoning Agreement provides for mixed-use development consisting of residential, institutional, and commercial uses, and includes regulations for site layout, building height and form, landscaping, and parking. The project is currently under development, and information can be found on the Engage Page for the original application (see Related Pages).

The applicant has requested to modify the text of the Zoning Agreement to:

• Reduce the number of parking spaces required on site;
• Increase the capacity for the child care centre from 30 to 66 children; and
• Add educational institutions, defined as “a post-secondary college, university or technical institution, but does not include a commercial or independent school,” and medical clinics, defined as “a building or part of a building where two or more members of the medical profession, dentists, chiropractors, osteopaths or occupational therapists provide diagnosis and treatment to the general public without overnight accommodation and may include such uses as reception areas, offices, consultation rooms, x-ray facilities and minor operating rooms, providing that all such uses have access only from the interior of the building,” as permitted land uses.

Application Process

1. Review by City Departments: When an application to amend a Zoning Agreement is received, the Planning and Development team checks if it follows the City's Official Community Plan, Zoning Bylaw and other rules. They also send it to other city departments to look at the technical details, such as if the water, wastewater, stormwater and transportation systems can support the proposal.
2. Public Engagement: After the internal review by the City, the public may review the proposal, ask questions and give feedback. Property owners within 75-150 meters of the site, the Community Association and the Ward Councillor are notified and invited to comment. Sometimes, a public meeting is held where the proposal is presented, and people can ask questions.
3. Municipal Planning Commission Review and City Council Public Hearing: The final decision is made by City Council at a Public Hearing. They consider the report and the recommendation and the feedback from the Municipal Planning Commission. Anyone from the public can submit written comments or speak at the hearing.

What is a Zoning Agreement?

All property in the City of Saskatoon is assigned a zoning designation under the Zoning Bylaw No. 9990, 2024. Specific land uses are permitted, prohibited, or discretionary within each zoning designation.

In some instances, a regulatory tool called a Zoning Agreement may be used when a specific development is proposed as part of a rezoning application. A Zoning Agreement is a binding legal agreement that, if approved by City Council, is tied to the land and ensures that only the specific development proposal put forward by the applicant can be constructed on the property. The Agreement may specify permitted uses of the land and standards respecting building form, scale, and site layout, among other considerations.
For this application, a Zoning Agreement is proposed to be employed to address specific development standards respecting building form, building height, number of dwelling units, and parking. Other items may be identified during the review process.
